Will of Joshua Joyce of Godalming 1760

 

 

In the Name of God Amen I Joshua Joyce of Godalming in the County of Surry

Baker do make this my last Will and Testament in manner and form  following and principally I comend my Soul

to God hoping to be saved by the Death of Jesus Christ and I order my Body to be decently Buried and as

concerning my Wordly Estate I give and dispose thereof as followeth, to wit, First I give and Devise unto

my Son James Joyce All that my Messuage or Tenements Garden and hereditaments with their appurts Situate

lying and being in the Townof Godalming aforesaid and now in the occupation of myself William Kibblewight

and William Hays To Hold and my said Son James his heirs and assigns for Ever - Also I Give Devise and

Bequeath unto my loving wife Elizabeth and her assigns All that my Messuage or Tenement Garden and

hereditaments with their and every of their appurtenances situate lying in and being in Godalming aforesaid

and now in my own occupation And also All and every my Utensils and Stock in Trade of what nature or kind

soever To Hold unto my said wife and her assigns for and during the Term of her natural Life if she so long

continue a widow and unmarried to and for her better support and maintenance and for enabling her the better

to support maintain and Educate my Children And from and after her decease or marriage again which

shall first happen I Give and Devise the said premises with their and every of their appurtenances

And also All that Messuage or Tenement Farm Lands and hereditaments with their appurtenances

Situate lying and being in Farncomb in the parish of Godalming aforesaid and now in the occupation of Richard

Panter unto my Brother in Law William Chitty and Friend Richard Chitty of Milford in the Parish of

Witley in the Said County Frameworkknitter and to their heirs Exexutors and Administrators In Trust to Sell

and Dispose of the same premises and out of the Moneys arising by such Sale to pay unto my five Daughters

Elizabeth Mary Letitia Sarah and Ann the Sum of One Hundred Pounds apeice of lawfull Money of Great Britain

on their respective days of Marriage or Ages of Twenty one Years which shall first happen respectively And to

pay the overplus of such Money arising by such Sale (if any be) unto and amongst my Six daughters Elizabeth

Mary Jenny the wife of Lawrence Lee Letitia Sarah and Ann equally between them to be divided share and

share alike And all the rest and residue of my Goods Chattles rights Credits ready Money and personal Estate

whatsoever and wheresoever I Give and Bequeath unto the said William Chitty and Richard Chitty their

Executors and Administrators In Trust to Sole receive and collect the same and out of the Moneys

thereby arising to pay all my just debts and Funeral expences and Probate of this my Will and after payment

thereof to pay and divide all the rest and residue of my said personal Estate unto and amongst my said Six

Daughters Elizabeth Mary Jenny Letitia Sarah and Ann equally between them share and share alike

and I make nominate and appoint the said William Chitty and Richard Chitty Joint Executors in Trust of

this my Will and I Will and Order that my said Executors in Trust shall be satisfied and reimbursed out of

my said personal Estate all Costs Charges Damages and Expences which they or either of them shall bear

sustain or be put unto in and about the execution of this my Will and for their time and trouble which

they shall Expend and have in and about the same And that my said Executors in Trust shall not be

answerable the one for the other of them nor for any more Money than shall come to their respective hands

by virtue hereof and I hereby revoke all former wills by me made.In Terstimony whereof I have to this my last Will and Testament contained in

two Sheets of paper set my hand to the first Sheet and my hand and Seal to this last sheet the fourth

day of September in the year of our Lord One Thousand Seven Hundred and Fifty seven

Joshua Joyce the Testator as and for his last Will

and Testament in the presence of us who have

hereunto subscribed our names as Witnesses thereof

in the presence and at the request of the said Testator

and in the sight of one another

This Will of Joshua Joyce of Godalming

in the County of Surry deceased was proved on the

twenty third day of May in the Year of Our Lord One thousand

Seven hundred and sixty before the Revd Thomas Garston

Clerk & Surrogate (pending our annual visitation)

by the Oath William Chitty and Richard Chitty the

Executors to whom Admininstration was granted

they being first sworn faithfully to administer

 

The within named William Chitty and

Richard Chitty, executors of Joshua

Joyce, were sworn to the due Execu-

-tion of the within mentioned Trust

this twenty third day of May in the

year of Our Lord one Thousand seven hun-

-dred and sixty before me
