Will of James Cock weaver of Haughton, Lancashire 1838

 

I James Cock of Haughton in the County of Lancaster Weaver do

make and publish this my last Will and Testament in manner now

following that is to say I order and direct all my just debts and funeral

expenses and the expenses of the probate and execution of this my will

to be paid by my Executor hereinafter named out of my personal

estate and effects and if the same shall be insufficient for that

purpose then I charge my real estate with the deficiency And I

give devise and bequeath unto my dear Wife Nancy Cock her heirs

executors administrators and assigns All that my messuage or

Dwellinghouse and shop and also the vacant Land or Garden

belonging thereto with all and every the rights members and appurte-

-nances thereunto respectively belonging or appertaining situate and being

in Tib Street within Haughton aforesaid and now severally in my own

occupation And also the money and accumulations and interest

thereof belonging to me and now being in the Stockport Savings

Bank And all other sums of money and debts owing to me from

any person or persons whomsoever Together with all my household

 

good and furniture clothing wearing apparel beds and bedding tools and

implements of trade and else all and singular other my real and personal

estate whatsoever and wheresoever and of what nature or kind soever the same

or any part thereof may consist To have hold receive and enjoy the said

messuage or dwellinghouse vacant land and garden money debts furniture

and all other my real and personal estate and effects as aforesaid (after or

subject to the payment of my debts and the expense aforesaid) Unto and

for the sole use and benefit and to be at the entire disposal of my

said dear Wife Nancy Cock her heirs executors administrators and

assigns for ever or for such estate and interest as I may have in the

same or any part thereof respectively Subject nevertheless to my said

messuage or dwellinghouse vacant Land Garden and the respective

appurtenances to the payment of the yearly chief or ground rent with

which the same premises are charged and to the covenants and

agreements contained in the Deed of Conveyance thereof and which on

the part of the Grantee of the same premises are to be observed and

performed And I - James Cock  - Thos T Pownall - Josh

Hibbert - appoint my said Wife Nancy Cock sole Executrix of this

my last Will and Testament and hereby cancelling all other wills

by me at any time heretofore made I do declare this to be my last

Will and Testament In Witness whereof I the said James Cock

the Testator have to the first sheet of this my last Will and

Testament (written on two sheets of paper) set my hand and

to this second and last sheet thereof my hand and seal this

seventh day of May in the year of our Lord One thousand

eight hundred and thirty eight - James Cock  - Signed

sealed published and declared by the said Testator as and for his last

Will and Testament in the presence of us who in his presence at

his request and in the presence of each other have hereunto

subscribed our names as witnesses to the due execution thereof

 

The 1st day of December 1838

Nancy Cock the sole Executrix in this Will named was

sworn in common form and she further made Oath that

the personal estate and effects of the Testator within the

Diocese of Chester were under the value of £200 Before me

John Handforth Surrogate

The testator died the sixth day of October 1838

Probate Issued Dated 17th December 1838
