Elenor Cross of Warfield 1705 Will

 

 

In the name of God Amen the seaventeenth day of July in the third yeare of the Reigne of our sovraigne Lady Anne by the grace of God of

England Scotland france and Ireland queen defender of the faith &c Annqs Dni one thousand seaven hundred and fowre I Elenor Cross of the

parish of Warfeild in the County of berks widdow being weake in body but of sound and perfect memory praise be given to God for the same and knowing

the uncertainty of this Life on Earth and being desirous to settle things in order doe make this my Last will and testament in Mannor and form following

(that is to say) first and principally I commend my soule to Almighty God my Creator Assuredly that I shall Receive full pardon and free Remission

of all sinns and be saved by the previous death and merrits of my blessed Saviour and Redeemer Christ Jesus, and my body to the earth from

whence it was taken to be buried in such decent and Christian manner as to my executor hereafter named shall be though meet and Convenient

and as touching such worldly Estate as the Lord in Mercy hath Lent mee my will and meaneing is the same shall be employed and bestowed as

hereafter by this my will is expressed and first I doe Revoke frustrate and make voyd all wills by mee formerly and declared and

appoynt this my Last Will and testament and none other Item I give and bequeath unto my daughter Mary Cox now wife of John Cox the sum

of twenty pounds of lawfull money of England Item I give and bequeath unto my said son in law John Cox and to his use two sons John & William one shilling a

peece Item I give and bequeath unto my sonn Daniell Cross and to his foure sonns William Daniell John and Robert one shilling apeece

Item I give and bequeath unto the five children of my sonn William Cross one shilling apeece Item I give and bequeath unto my sonn in Law

Henry Matthews and to his foure sonns William Edward Henry and John one shilling apeece Item I give devise and bequeath unto my said sonn

William Cross all that my close of Earable or pasture Land Called by the Name of Alders lying and being in Warfeild afforesaid in the tithing of Uptown

to have and to hold the said Close of Land with all and singular the Appurtenances thereunto belonging to the onely use and behoof of the said

William Cross dureing his Natureall Life and after the cease of the said William Cross I give and bequeath the said Close of Land

with appurtenances to the onely propper use benefitt and behoof of Jane the now wife of the said William Cross dureing the term of her

Natureall Life and after the decease of the said William Cross and Jane Cross I give and bequeath the said Close of Land with the

Appurtenances unto the heires of the bodyes of the said William and Jane Cross for ever According to the Customs of the Mannor of Warfeild

aforesaid my further will is that the said heires shall pay such Legacies out of the said Land to the other children of the said William and Jane

Cross (begotten of the body of the said Jane) as they the said William and Jane Cross or the survivor of them by theire Last Will and testament shall think

Convenient to Appoynt and further that the said William Cross and Jane Cross or their heires shall pay the Legacies herein given and

discharge all such debts as I shall justly owe at my decease and if it shall happen that any of the said debts of Legacies be not paid by

my Executors within two yeares next Ensueing after my decease then my will is that they to whom such default of payment is made

shall have hold possess and peaceably enjoy the said Close of Land with the Appurtenances untill theire debts or Legacies be fully paid

And Lastly I doe make ordaine Constitute and Appoynt my said William Cross an Jane his now wife to be sole Executors of this

my last Will and testament to whome I give all Goods and Chattles that shall be Left of mine when all Legacies debts and funerall

Charges shall be fully satisfied. In witnes whereof I have hereunto set my hand and seale the day and yeare above written
